Dubai Court Orders Son to Vacate Father’s Home Despite Family Ties

A Dubai Civil Court has ordered a man to leave his father’s home within two months. The court said that just because they are family, it doesn’t mean the son can stay there if the father owns the property.

The case was about a father and son who couldn’t agree on the home. The father wanted his son to move out so he could give the home to another son who is getting married.

The court said that if someone owns a property, they get to decide who lives there. The son had been living there for years. The father didn’t want him to. The court said that was like breaking the law.

The court looked at documents that showed the son had another home in Al Khawaneej and that his father had helped him pay for it. So the son could move to that home. He didn’t want to leave his father’s home.

The father showed documents that proved he owned the home. He got the property in 2005. He also showed that he needed to give the home to another son.

The son’s defence was that he had lived there for a time, so he should get to stay. The court said that wasn’t enough. He needed to show documents that proved he owned the home or had a right to live there. He couldn’t.

The Dubai Civil Court said:

  • If someone has a property certificate that proves they own it, unless someone can prove it’s fake.
  • If someone lives in a home without the owners permission thats not allowed.
  • If someone helps pay for a home, that doesn’t mean they own it unless it’s official.

The court also said that just because someone owns the land, it doesn’t mean they don’t own the house on it. The son has two months to leave the home. He also has to pay all the court costs.

This decision is important in the United Arab Emirates. It means that if someone owns a property, they get to decide who lives there, even if it’s a family member. This will help decide cases in the future.
